Le Shérif Boone conduit John à Elmdale pour la tenue de son procès. On l'accuse d'avoir falsifié le titre de propriété du terrain sur lequel il a bâti La Nouvelle-Babylone. Django tente d'intercéder auprès du juge Fourier, qu'il connait depuis la guerre de Sécession. De son côté, Seymour menace de mettre le feu aux puits de pétrole de La Nouvelle-Babylone pour que les habitants rallient la cause d'Elizabeth.
